AN ACT to amend article five, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section two-d, relating to increasing level of state-funded per pupil support for certain community and technical colleges.

Be it enacted by the Legislature of West Virginia:
That article five, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section two- d, to read as follows:
ARTICLE 5. HIGHER EDUCATION BUDGETS AND EXPENDITURES.
§18B-5-2d. Community and technical college allocation.
Each year the governing boards must request a special appropriation from the Legislature to fund an additional allocation to West Virginia Northern Community and Technical College, Southern West Virginia Community and Technical College, Potomac State College of West Virginia University and West Virginia University at Parkersburg, or any other community and technical college so designated in the appropriations bill. The total amount requested must equal any difference in per student appropriations existing between the public four-year baccalaureate institutions and the community and technical colleges set out above, as calculated by the resource allocation model and resource allocation policies of the governing boards. Any appropriations received by the governing boards under this section must be allocated consistent with the appropriation request or must be reduced proportionally for each institution, if sufficient legislative appropriation is not made.
